1. This Agreement on observation, confidentiality and personal data (hereinafter - the “Agreement”) regulates the relationships between the Primary User and the Observer arising in connection with transfer, collection, processing, storage and use of personal data in the course of using Beetis mobile application. Pressing the “Accept” button the User unconditionally accepts all provisions of this Agreement and undertakes to comply with them.

2. The capitalized terms in this Agreement are construed in accordance with the definitions thereof specified in para. 2 of the User agreement (Offer) available at the address www.beetis.io/oferta.

3. The Parties hereby confirm that in the course of using Beetis application the Primary User shall enter the Metrics and the Observer shall have access to the nickname of the Primary User entered in the course of registration, as well as to the parameters of the application of the Primary User and to his/her Metrics.

4. Observers can enter, update and delete the Metrics of the Primary User with the appropriate permission granted by the Primary User to the Observer within the Beetis application.

5. The Metrics include the information about the consumed products and medicines, as well as measurements of the level of substances in the body conducted by the Primary User.

6. Observers' nickname is visible for all observers of Primary User as well as the his/her Metrics.

7. Performing downloading of Metrics and observation, the Parties rely on the User agreement (Offer) and the Regulation on personal data accepted by them at the moment of registration by means of pressing the consent button.

8. Entering registration details and the Metrics the Primary User agrees that these data shall be available to the Observer to whom the Primary User granted access to observation.

9. The Observer shall use the Metrics entered by the Primary User exclusively for observation purposes.

10. The Observer doesn’t have the right to transfer the Metrics of the Primary User to third parties except the cases when the Primary User has given the respective express and direct instruction. In the latter case the further legal relationships between the Parties shall take place beyond the scope of using Beetis.

11. The Observer has no right to use the Metrics with any purposes apart from the direct purpose of Beetis.

12. The Observer has no right to make copies of Metrics and to store them on expiration of the observation period. Termination of observation means termination of access of the Observer to the Metrics of the Primary User.

13. In case of unlawful transfer or leak of the data of the Primary User the Observer bears responsibility in accordance with the provisions of the existing laws of the European Union.

14. In case the User learns about the leak of personal data or about the threat of such leak the User shall inform the Operator about this. The Operator shall within 72 hours inform the User about the measures taken in order to preserve the confidentiality of the personal data of the Users. In case the Operator detects a leak of personal data of the Users that has occurred, the Operator shall within 72 hours from the moment the leak became known to him, inform the Users about this, and also inform about the measures taken in order to preserve the confidentiality of the personal data of the Users.

15. The Operator doesn’t bear responsibility for the consequences of leak of the User’s personal data if such leak occurred through the fault of other Users to whom became known the personal data as the result of direct declaration of will of the personal data subject.
